MyVideoTracker is a video sharing and viewer tracking platform. It allows account owners to upload videos, create shareable trackable links with optional gates and calls-to-action, and monitor viewer engagement in real time (the “Service”). New accounts begin with a 30-day introductory period for a one-time $50 setup fee. After the introductory period ends, the Service continues on a paid subscription unless you cancel before it expires.

We may add, change, or remove features over time. We will give you reasonable notice of material changes that affect the core functionality you pay for.

You must be at least 18 years old and able to enter into a binding contract under the law of your jurisdiction to use the Service.

You are responsible for ensuring that your use of the Service and your collection of viewer data complies with all applicable laws in your jurisdiction and in the jurisdictions of your viewers.

• Provide accurate, current information when you register.
• Keep your password confidential. You are responsible for all activity under your account.
• Notify us immediately at info@myvideotracker.com of any unauthorized use.
• One account per person or organization. Account sharing outside your team plan is not permitted.

5.1 Introductory period

New accounts begin with a 30-day introductory period with full access to the Service, including unlimited trackable links. A one-time $50 setup fee is charged at the time of signup. Monthly subscription billing does not begin until the introductory period ends. If you cancel before the introductory period ends, no monthly charges will apply, but the setup fee is non-refundable. You can cancel at any time during the trial from your account dashboard or by emailing info@myvideotracker.com.

5.2 Subscription and setup fee

After the introductory period, the Service is billed as follows:

• One-time setup fee: $50, charged once at signup. No additional onboarding fee applies when you add seat packs or otherwise upgrade later.
• Base plan: $59/month, which includes unlimited trackable links and 1 team seat.
• Team seat packs: $20/month per pack of 5 additional team seats. A seat is used when you assign a link to a team member. You may add or remove packs at any time; changes take effect at the next billing cycle.

Current pricing is displayed on the website before you check out.

5.3 Payment

Payments are processed by Stripe. By subscribing, you authorize us to charge the payment method on file at the start of each billing cycle until you cancel.

5.4 Auto-renewal

Subscriptions renew automatically each month at the then-current rate. We will notify you by email before any price increase takes effect.

5.5 Taxes

Prices may exclude applicable taxes. Any taxes will be added at checkout where required by law.

5.6 Failed payments

If a payment fails, we may retry the charge, suspend access, and ultimately terminate the subscription.

You may cancel at any time from your account dashboard or by emailing info@myvideotracker.com. If you cancel a paid subscription, cancellation takes effect at the end of the current billing period and you keep access until then.

The one-time setup fee is non-refundable.

Monthly subscription fees are non-refundable except where required by law or expressly granted by us in writing.

If we suspend or terminate your account for a breach you caused, you are not entitled to a refund for the remaining period.

Subject to your compliance with these Terms and your active trial or paid subscription, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your own business purposes.

You may NOT:

• Resell, sublicense, redistribute, or republish the Service as a competing product.
• Share your account credentials outside your team plan.
• Use the Service to build a similar or competing product.
• Remove copyright or attribution notices.
• Scrape, crawl, or otherwise extract data from the Service at scale.

All intellectual property in the Service remains with myvideotracker.com or our licensors.

You retain ownership of any content you submit, including videos, link configurations, and branding (“Your Content”). By submitting Your Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, transcode, deliver, and display it back as needed to operate the Service.

You represent that:

• You own or have the rights to use all content you upload, and it does not infringe any third-party rights.
• You have a lawful basis to collect viewer data from the people you share links with, and you have made appropriate disclosures to your viewers.
• You will not use the Service to collect viewer data in violation of applicable privacy laws.

You are solely responsible for any viewer data you collect through the Service and for your relationship with your viewers. We process viewer data on your behalf as described in our Privacy Policy.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law.
• Upload or share content you do not have the right to use, or that infringes the rights of others.
• Upload viruses, malware, or any code intended to disrupt the Service.
• Use the Service to deceive, defraud, harass, or harm viewers.
• Interfere with or compromise the security of the Service.
• Attempt to reverse engineer, decompile, or extract source code.
• Use the Service to share illegal content, including content that violates export controls or sanctions.

You may terminate your account at any time. We may suspend or terminate your account if you breach these Terms, fail to pay, or use the Service in a way that creates legal or operational risk for us. We will give you notice where reasonably possible.

On termination, your right to use the Service ends. Sections that by their nature should survive (intellectual property, disclaimers, limitation of liability, indemnification, governing law) will survive termination.

The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Service will be uninterrupted, error-free, or that all viewer tracking data will be complete or accurate. Network conditions, browser settings, and ad-blocking software may affect data capture.

This section does not limit any statutory consumer rights you have under applicable law.

To the maximum extent permitted by law:

• Our aggregate liability for all claims arising out of or relating to the Service in any 12-month period will not exceed the total fees you paid us in the preceding 12 months, or USD 100, whichever is greater.
• We are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, lost profits, lost revenue, lost data, or business interruption.

Nothing in these Terms excludes or limits liability for fraud, willful misconduct, death or personal injury caused by negligence, or any other liability that cannot be excluded under applicable law.

You agree to indemnify and hold harmless myvideotracker.com and its officers, directors, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your breach of these Terms, Your Content, your collection or use of viewer data, or your use of the Service in violation of applicable law.

We may update these Terms from time to time. We will post the new version on this page and update the “Last updated” date. For material changes, we will notify you by email or a prominent notice in the Service at least 30 days before the change takes effect. Your continued use after the effective date means you accept the new Terms. If you do not accept, cancel before the effective date.

These Terms are governed by the laws of the State of Michigan, USA, without regard to its conflict of laws principles. Any dispute will be resolved in the state or federal courts located in Michigan, and you consent to personal jurisdiction there.

• Entire agreement: these Terms, together with the Privacy Policy, are the entire agreement between you and us.
• Severability: if any provision is held unenforceable, the rest remains in effect.
• No waiver: failure to enforce a provision is not a waiver of our right to enforce it later.
• Assignment: you may not assign these Terms. We may assign them in connection with a merger or sale of assets.
• Force majeure: we are not liable for delays caused by events beyond our reasonable control.
